RestoreOurColorado.org is joining Louisiana and New Jersey recall committees in the formation of a National Coalition with the mission of asserting and promoting our 1st Amendment right to petition our Government for the redress of grievances.

The group will be known as
"RIGHT2RECALL - A National Coalition of WE THE PEOPLE, exercising our right to petition the Government for redress of grievances."

Ruben LeBlanc, MoveOnMary.org in Louisiana, has been speaking with representative in Washington state, and they are ready to be the fourth state join this coalition.
On 26-FEB-2010, New Jersey TEA Party Patriots get day in court to appeal New Jersey SoS Senate RECALL petition rejection.

In addition to restoring our representation to WE THE PEOPLE, RestoreOurColorado.org committee believes that laser focused Legislation initiatives will aid in the restoration of fiscal sanity to our state. Please register to be a Minuteman Petition Network Volunteer in what ever capacity you can. RestoreOurColorado.org is organizing a non-partisan campaign to exercise ARTICLE XXI
RECALL FROM OFFICE of the Colorado State Constitution, to petition the Government for a redress of grievances with our U.S. Senate delegation.

This campaign will require registered elector signatures at least 25% of the votes cast for Senator Udall's election in 2008, approximately 576,000 petition signers.

To gather the required signatures, we need the support and efforts of citizens, politically active groups, and Business owners. The next step is to choose one of the buttons on the left to get more information and Register to help in areas of interest and capability.

Why Recall?

A brief refresher from our Colorado State Constitution, Bill of Rights defines our relationship with our government: Individual liberty and rights are inherent, and such rights are not derived from the constitution, but belong to the individual by natural endowment. Government derives from surrender of individual rights. Government exists through the surrender by the individual of a portion of his naturally endowed and inherent rights. The people of this state have the sole and exclusive right of governing themselves, as a free, sovereign and independent state; and to alter and abolish their constitution and form of government whenever they may deem it necessary to their safety and happiness, provided, such change be not repugnant to the constitution of the United States. Is it not reasonable to expect that our Elected Representation adhere to STATE LAW when they head off to represent us at our capitol offices?

Constitutionality

This is an event that may very well shake the underpinnings of the Colorado Political House. We fully expect that we will be met with a resistance to accept this Petition by the personnel of the Secretary based on an earlier request and subsequent refusal for the document templates for the petition.
We were told at that time that their office would not provide the documents and templates requested because such action was unconstitutional. The last time protocols were checked, it was not up to the office of the Secretary of State to determine the constitutionality of anything. Determining the constitutionality of issues lays fully on the Supreme Court system. We believe this to be yet another governmental usurpation of liberty and blurring of the very clear separation of powers.

Below are two portions from Article 21, Section 1 that are of importance. Within these two portions you will find that not only is the recall provided for, but also that the legality and sufficiency of the recall rest solely with the electorate (voters).

Article 21, Section 1. State officers may be recalled. Every elective public officer of the state of Colorado may be recalled from office at any time by the registered electors entitled to vote for a successor of such incumbent through the procedure and in the manner herein provided for, which procedure shall be known as the recall, and shall be in addition to and without excluding any other method of removal provided by law.

The registered electors shall be the sole and exclusive judges of the legality, reasonableness and sufficiency of such ground or grounds assigned for such recall, and said ground or grounds shall not be open to review.


Section 4, This article is self executing, but legislation may be enacted to facilitate its operations, but in no way limiting or restricting the provisions of this article, or the powers herein reserved.
The People of Colorado are prepared to take a stand; We ask that YOU be there to document these efforts to exercise the rights of the people of Colorado to determine and maintain their representation as outlined by the Constitution of the State of Colorado.
